Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The Federal Arbitration Act governs the arbitration agreement below.
Informal resolution
Before filing a claim, please email @yaps.ggwith “Dispute” in the subject line so we can try to resolve it. If we cannot resolve it within 30 days, either party may proceed.
Arbitration
Disputes will be resolved by binding individual arbitration administered by JAMS before a single arbitrator. Hearings may be held by video or phone, or in person (U.S. consumers may choose their county of residence).
Exceptions
- Small-claims matters may proceed in small-claims court (your county or New Castle County, Delaware).
- Claims seeking only public injunctive relief may proceed in court.
- Intellectual-property disputes may proceed in court.
Class waiver
Claims may be brought only on an individual basis — no class actions or class arbitrations — and the arbitrator may not consolidate claims.
30-day opt-out
You may opt out of this arbitration section within 30 days of first accepting these Terms by emailing @yaps.gg with your name, account email, and a clear opt-out request. If you opt out, neither party is bound by this section for future disputes.
